Add a Release Order

Once an initiating process or Order for Arrest (OFA) is issued, it is then available for attachment of various subsequent processes. The first subsequent process commonly added to a case is a Release Order, which is a document describing the conditions under which a Defendant will be released from custody or held until trial.

A Release Order can be added (pre-entered) from either the MAIN MENU or directly from any initiating process (or OFA). Both methods are detailed below. Click on the provided link in a step for more Help on that particular step.

Before you start:

  • Only users with the proper rights can add a Release Order.

  • As with initiating processes, the Defendant, Offenses, Conditions, and Court Information are not required information when first adding (pre-entering) a Release Order. This data can be entered whenever available and will be stored as an Incomplete or Complete Release Order. To issue a Release order, however, requires this information.   • The process on a case to which a Release Order is assigned is based on whether the Release Order is added generally to a case, or specifically to a process. Click here for details.

  • Only one Release Order with a status of Complete or Incomplete can be assigned to a process.

  • Once a Release Order is initially added from the MAIN MENU or directly from an initiating process, specific information (Conditions, Court Information, etc) may be entered in any order.

  • During an add or edit of a Release Order, if the Defendant on the initiating process has been edited since issuance of the process, then the most current Defendant data will populate the Release Order DEFENDANT tab. The original Defendant name from the initiating process will display as an alias.

  • Release Orders (and service data) on Warrants and OFAs transmitted to NCAWARE by a local system interface are handled differently than Release Orders entered directly into NCAWARE. Click here for details.

 

  1. Perform the initial step that matches your current situation:

Note: A search by File Number is the most efficient method of searching for an initiating process.

    1. The RELEASE ORDER TAB VIEW displays defaulted to the DEFENDANT tab. On the displayed DEFENDANT tab, the Defendant data from the initiating process is defaulted. Review this data. If the data needs to be updated, edit the Defendant, otherwise click the OFFENSES tab.

    2. The OFFENSES tab displays with the Offenses from the initiating process. Review the Offenses.

Note: Offenses cannot be edited or deleted from a Release Order.

    1. Add Conditions of Release to the Release Order.

    2. Attach related cases to the Release Order, if necessary.

    3. Add Court Information to the Release Order (or edit the Court Info defaulted from the initiating process, if necessary).

    4. Add any Additional Conditions Forms to the Release Order, if necessary.

    5. Edit the Summary and enter the required fields Date Issued,  Date Served, and County Served if the Release Order is to be issued. This tab also allows for the entering of the Date of Arrest and Check Digit Number or Reason Code.

Once all the above required and additional information is entered , the Release Order can be issued (if not already accomplished in Step #8) and printed.
