ACIS

An acronym for the AOC Automated Criminal Infraction System.

affiant

The person who signs an affidavit.

Affidavit

A sworn and signed statement of facts. The person swearing to the facts is known as the affiant. In Statewide Search, Affidavits appear on the Fugitive Warrant and CVR-8 processes.

AFIS

An acronym for Automated Fingerprint Identification System.

Agency

A legal body with associated members.  Typically associated with a Law Enforcement Agency.

Aliases

Names attached to a Person record that has been known to be used by the person or associates. This is separate from a Fraudulent Name, which is an incorrect Name used in legal or financial situations.

AOC

(North Carolina) Administrative Office of the Courts

Appearance Bond (AB)

An official receipt of moneys posted with the courts to guarantee that an individual will be present for a scheduled court date. An Appearance Bond will list the Bond Type, Bondsmen data, and the Amount posted.

Arrest

The act of taking a person into custody based on a previous charge or the committing of an offense.

Arrest Number

The number assigned by a local agency to identify an arrest.

Arresting Agency

The agency that made the arrest based on an issued process.

BAC

An acronym for Blood Alcohol Content.

Case

A collection of processes relating to a charge against a defendant.  There will be an initiating process and any number of subsequent processes.

Charge

Another term for the offense on a process.

Charging Text

A combination of default and user-entered data that defines and provides the details of an offense on a process.  (Note:  Charging Text may also be referred to as Charging Language.)

Check Digit Number

Unique fingerprint card tracking number assigned by DCI. It is used to identify an individual and follow their arrest history.

Citation Number

Identifier assigned by a law enforcement agency to track citations.

Clerk

An assistant or deputy to the CSC working in the criminal division.

Clerk of Superior Court (CSC)

An elected official in each county. The Clerk of Superior Court is paid by the state and is responsible for all clerical and record-keeping functions of the superior court and district court. In criminal matters they are empowered to issue arrest and search warrants, although they infrequently use this authority. They are also empowered to exercise the same powers as a magistrate with respect to taking waivers of trial and pleas of guilty to minor offenses.

Complainant

The entity in the case bringing the charge against the defendant.  A complainant can be a person, business or LEO.

Contact, business

The primary contact person for a business in NCAWARE.

County

A North Carolina, or other State's, county.  There are 100 counties in NC.

Crime

In NCAWARE, the description of the original offense for which a defendant on a Fugitive Warrant or Order is wanted and has fled. The Crime(s) are not to be confused with the actual offense on Fugitive processes, which is \"Extradition/Other State.\"

Criminal Record Number - District Court (CR)

A number assigned to a case once the case is issued by an official with Issuing Authority. The format for a CR (or CRS) number is: YYTTTNNNNNN where YY = Year, TTT = Case Type, and NNNNNN = Sequence Number.

Criminal Record Number - Superior Court (CRS)

A number assigned to a case at the Superior Court level. Except for the Case Type of 'CRS', the format is identical to a CR number: YYTTTNNNNNN where YY = Year, TTT = Case Type, and NNNNNN = Sequence Number.

Criminal Record Number (CR)

A number assigned to a case once the case is issued by an official with Issuing Authority. The format for a CR (or CRS) number is: YYTTTNNNNNN where YY = Year, TTT = Case Type, and NNNNNN = Sequence Number.

Criminal Summons (CS)

A document issued requesting the defendant appear in court at the specified time to answer the specified charges. When the defendant is a person, the offense must be a misdemeanor. When the defendant is a business, the offense may be a felony.

CVR (Civil Revocation)

A process that revokes a person's driver's license.  A CVR-2 form is the form to revoke a license.  A CVR-8 is the associated affidavit signed by the defendant if not in possession of a NC driver's license.

Date of Arrest

Date the individual was arrested or date the individual was fingerprinted.

Date Of Birth (DOB)

The Date of Birth of the individual. This can be a verified date, or an estimated date, which in instances where the DOB for a Person being entered into NCAWARE is unknown, an approximate age is entered and the DOB is calculated from the age and the date the record was entered.  (Ex: Age 25 entered on 08/20/2002 will be calculated to the DOB of 08/20/1977.)  An estimated DOB displays with a \"+\" next to it.

DCI

An acronym for the State Bureau of Investigation's Division of Criminal Information.

Defendant

The entity in a case that is being charged.  A defendant is a person on all initiating processes with the exception of ALE/ABC, General, and Wildlife Citations, Criminal Summons, and Worthless Check Summons, where the defendant may also be a business.

Dept. of Correction Number (DOC)

A unique inmate number assigned by the Department of Correction to a person that has been incarcerated.

Dept. of Motor Vehicles Number (DMV)

A unique identifier assigned by a state Division of Motor Vehicles to an individual. This can be a Drivers License Number or an Identification Card issued by DMV.

Domestic Violence

A field that indicates a case involves domestic violence by the defendant.

DWLR

An acronym for Driving While License Revoked.

Estimated Date of Birth

In instances where the Date of Birth (DOB) for a Person being entered into NCAWARE is unknown, an approximate age is entered and the DOB is calculated from the age and the date the record was entered.  (Ex: Age 25 entered on 08/20/2002 will be calculated to the DOB of 08/20/1977.)  An estimated DOB displays with a \"+\" next to it.

Federal Bureau of Investigation Number (FBI)

A unique person identifier assigned by the Federal Bureau of Investigation based on fingerprint identification.

File Number

A number generated and assigned to a case when the initiating process is issued. Each county has a specific set of file numbers that are recycled each year.  A file number consists of (Year) (Type) (6 digit county specific number).  Each case issued causes the county specific number to be incremented.

Fugitive Warrant (FW)

A document created for a defendant, not in custody, who is a fugitive from another state.

General Statute

The code assigned by the NC Legislature to identify the laws.  Example:  G.S. 15A-304. The format of a G.S. Number is: <SUFFIX><SPACE><NCAC><SPACE><CHAPTER><SUBCHAPTER><DECIMAL><RULE> TITLE (required): 2 numeral characters SUFFIX (optional): 1 alpha character <SPACE> (required) 1 space character NCAC (required): exact match <SPACE> (required): 1 space character CHAPTER (required): 2 numeral characters SUBCHAPTER (optional): 1 alpha character <DECIMAL> (required): 1 decimal character RULE (required).<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_I"></a><nobr><b>Initiating Process</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">The initial charging document in a case against a defendant.  It is a subset of the full process list.  An initiating process can be any of the following: Warrant for Arrest, Criminal Summons, Magistrate Order, Wildlife, ALE/ABC, or General Citation resulting in a Magistrate Order, Worthless Check Criminal Summons, Worthless Check Warrant, Fugitive Order or Fugitive Warrant.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Issue</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">The act of a completed process being approved by an issuing authority. The date a process is issued (made active) is known as the Issue Date. Subsequent processes (Release Order, Appearance Bond) can also have a status of Issued.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Issuing Authority</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A person with authority to issue a process in NCAWARE.  This is a Magistrate, Clerk or Judge.<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_L"></a><nobr><b>LEA</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">An acronym for Law Enforcement Agency.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Lead Case</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">When attaching other processes linked to a Defendant to a Release Order or OFA, the case from where the Release Order or OFA was originally generated is considered the \"Lead\" case.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>LEO</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">An acronym for Law Enforcement Officer.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Local Case Number</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A number assigned locally to identify a case.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Local Identification Number (LID)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A number assigned to an individual by local law or judicial officials.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Local Ordinance (\"99\" Code)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">An offense active only within a defined county.  Also known as a \"99\" Code.<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_M"></a><nobr><b>Magistrate</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">An appointed official with the authority to adjudicate and issue processes.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Magistrate System</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Current production application that NCAWARE is scheduled to replace. The Magistrate System primarily handles the Magistrate functions of creating, issuing, and tracking processes. It also maintains links and displays warnings concerning outstanding processes.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Misc. ID Numbers</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Miscellaneous Identification Numbers that could be assigned to an individual. It is operational 24 hours a day, 365 days a year.<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_O"></a><nobr><b>OCA Number</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">The originating case agency's identifier.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Offense</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">The definition of the act of breaking the law that results in the creation of the initiating process.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Offense Code</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A 4-digit code used to identify an offense.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Order For Arrest (OFA)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A subsequent document that is generated when the defendant does not meet the conditions set in a Release Order. An Order for Arrest can be associated with more than one case.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Order to Surrender License</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A CR-341 (\"Order to Surrender License or Limited Driving Privileges\") is required for certain offenses (currently Offense Codes 5560 and 5553) that deal with driving with a revoked license. These offenses are most commonly entered on a General Citation.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>ORI</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">An acronym for Originating Agency Identifier. The ORI is a nine-character identifier assigned by the FBI Criminal Justice Information Services (CJIS) Division staff to an agency which has met the established qualifying criteria for ORI assignments to identify the agency in the transactions on their NCIC 2000 system.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Originating Case Agency (OCA)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">The name of the agency that originally initiated the case.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Outstanding Processes</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Issued processes against a Defendant that have yet to be served. The Statewide Search status of such processes is Unserved.<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_P"></a><nobr><b>Paper (Unserved - Paper)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">\"Paper\" is a sub-status of the process state Unserved. The sub-state \"Paper\" will display on any process that fits one of the following situations:                                                            -  *The process is of the state Unserved and was converted from ACIS to NCAWARE (and has not had the action \"Converted to Electronic\" performed in Process Tracking.);                                                                                            *or The process is of the state Unserved, and the process has been locally assigned (through Process Tracking) to an agency NOT implemented on NCAWARE.                                        An additional sub-status of \"Verified\" or \"Not Verified\" is assigned based on whether or not a Clerk or LEO has confirmed that the process is currently Unserved.                        The Paper and Verified/Not Verified sub-states will restrict certain actions and trigger certain informational messages.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Participant</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A Complainant, Defendant, or Witness on a process.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Personal ID Number (PID)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A unique Identification number assigned by a local agency to an individual based on fingerprint data.  A PID performs the same function as an LID, but is tracked separately since, unlike an LID, it can only be maintained by interface.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Probable Cause</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Facts or evidence that would lead a reasonable person to believe that a crime has been, is being, or will be committed, and the person arrested is responsible.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Process</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">The general term used to describe the host of legal processes available for views, adds, edits, and deletes.  In Statewide Search, these are: Warrant For Arrest, Criminal Summons, Fugitive Warrant, Worthless Check Warrant, Worthless Check Summons, Order for Arrest<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Process Number</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A number given to an individual process in the system.  It consists of (Year) (Type) (6 digit statewide number). The Proxy is authorized to perform certain judicial functions for the user in a single county only.<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_R"></a><nobr><b>Reason Code</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Reason entered on a process explaining why fingerprint information was not included.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Release Order (RO)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A document created by the magistrate describing the conditions under which the defendant will be released from custody or held until trial.  This can be related to multiple cases, but some counties require a one-to-one relationship with the initiating process.<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_S"></a><nobr><b>Served</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A process state where the process contains a Service Date, either through issuance (i.e. Orders, Citations), through a Release Order, or via Process Tracking.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Severity/Class</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Severity/Classes are assigned to Offense Titles by the SSA and are used for determination of Structured Sentencing. LDAs may assign Severity/Classes to Local (99) Offense Titles.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>SHP</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">An acronym for State Highway Patrol.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Social Security Number (SSN)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Individual person identifier assigned by the US Social Security Administration.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Soundex</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Search protocol utilizing the phonetic sound of search criteria (usually names) as opposed to spelling/letter order.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>State Identification Number (SID)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A unique person identifier assigned by the NC State Bureau of Investigation based on fingerprint identification.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>State System Administrator (SSA)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">The person assigned to perform high-level data administration in NCAWARE.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Status, Process</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">The current state of an entered process determined by the latest action performed on the process, either by a user or via an interface. Only processes with the status of \"Unserved\" are returned in the Statewide Search  application.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Structured Sentencing</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Legislation that classifies offenders on the basis of the severity of their crime and on the extent and gravity of their prior criminal record. Based on these two factors, structured sentencing provides judges with sentencing options for the type and length of sentences, which may be imposed.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Subpoena</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A document requesting an entity's presence in court on a particular date with instructions on what to bring if required.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Subsequent process</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Additional processes in a case.  These can be Release Orders, Appearance Bonds or Orders for Arrest.  There may be several subsequent processes in a case, but only one (1) initiating process.<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_U"></a><nobr><b>Unserved</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Process state where the process is issued but does not contain a Service Date.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>User</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Anyone with authority to access the Statewide Search application.<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_V"></a><nobr><b>Verified/ Not Verified</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">Verified/Not Verified is a sub-state of the process state/sub-state Unserved - Paper, and is only relevant to Unserved processes converted from ACIS.                  If the Unserved - Paper process displays Verified, then a Clerk or LEO has confirmed that the process is currently Unserved (by locating the original copies).    Conversely, if the Unserved - Paper process displays Not Verified, then no confirmation of the original paper process' status of Unserved has occurred.                                                      The Paper and Verified/Not Verified sub-states will restrict certain actions and trigger certain informational messages.                        The sub-state Not Verified can be changed to Verified by one of two methods:                                                                                                                        *If prior to conversion, the process status of Unserved is confirmed and the related flag is set for the process in ACIS; or *The process (case) has been updated with the Verified by Copy or Verified by Original through the NCAWARE process tracking function.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Victim Rights</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">An indicator that a case involves offenses that qualifies under the Victims' Rights Act (VRA).<p> <p class="glsbody" style="margin-bottom:1pt;"><a name="bm_W"></a><nobr><b>Warrant For Arrest (WFA)</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A document issued giving the authority to arrest the specified defendant for the specified charge(s).<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Witness</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">The entity in the case testifying that they were present and witnessed the crime the defendant is being charged with.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Worthless Check Criminal Summons</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A document issued requesting the defendant appear in court at the specified time to answer the specified charges for a worthless check.<p> <p class="glsbody" style="margin-bottom:1pt;"><nobr><b>Worthless Check Warrant</b></nobr></p> <p class="glsbody" style="margin-top:1pt;">A document issued giving the authority to arrest the specified defendant for the specified charge(s) based on a worthless check offense.<p> <p class="glsbody"><br><br></p> </body> </html>
